Privacy policy: Personal data in the Title and Mortgages Register

Why is personal data processed?

The National Land Survey of Finland (NLS) processes personal data in order to maintain the data in the Title and Mortgages Register (lainhuuto- ja kiinnitysrekisteri), to protect the interests of right holders and third parties, and to offer the information service.

What is the basis for the processing of personal data?

The NLS processes personal data to comply with its statutory obligations.  

Whose personal data is processed?

The NLS processes the data of the following individuals in the Title and Mortgages Register:

  • Owners of properties, unseparated parcels, parcels or surrendered interests in joint property units
  • Holders of interests in properties
  • Holders of rights in unseparated parcels, parcels or interests in a joint property unit.

What personal data is processed? 

  • Names
  • Personal identity codes
  • Contact details
  • Times of death  
  • Foreclosures, preventive measures or owners’ bankruptcies  
  • Restrictions on property rights (usufruct based on law or a will or a condition linked to an applicant’s acquisition)
  • Statutory liens
  • Receivers of written mortgage deeds 

Is automated decision-making or profiling used?

The NLS uses automated decision-making in simple mortgage confirmations and electronic mortgage deed transfers.

The NLS can make positive decisions automatically if the statutory prerequisites for the confirmation of mortgage or the transfer of an electronic mortgage deed are met. In other cases, the matter will be manually processed.

Automated decision-making does not include any evaluation of the personal characteristics of individuals (“profiling”). Decision-making is based on property-related information.

How long is the personal data retained?

The NLS permanently retains the data entered in the Title and Mortgages Register, unless otherwise provided by law. 

Where does the personal data come from?  

The NLS receives data in the following ways: 

  • Information on the conveyance of real property from the Title and Mortgages Register
  • From property registration applications
  • From the National Enforcement Authority
  • From information systems maintained by other authorities such as the Population Information System and the Trade Register.

To whom is personal data disclosed?

The NLS discloses personal data upon request to anyone. Data is disclosed in the form of extracts, certificates and other printouts, via the NLS’s e-service, as well as through the technical interface.

The NLS may disclose personal data through the technical interface to:  

  • The judicial administration
  • Regional State Administrative Agencies  
  • Centres for Economic Development, Transport and the Environment  
  • Municipalities  
  • Finnish Tax Administration  
  • Security authorities such as the Finnish Defence Forces and the police  
  • Digital and Population Data Services Agency  
  • Metsähallitus  
  • Public purchase witnesses
  • Senate Properties.

Furthermore, the NLS may disclose personal data with a separate licence via the technical interface to an individual who needs the information for the purposes of urban planning, real estate brokerage, property appraisal, the granting and monitoring of credit or other comparable purposes related to properties or ensuring national security.

Personal data is not transferred outside the EU or the EEA.

The NLS does not disclose personal data for the purposes of direct marketing, surveys or market research, unless disclosure for this purpose is specifically provided for.

The NLS discloses documents containing personal data to a requesting party by law. Documents of the NLS are public unless specified non-disclosable by law. 

What are your rights in relation to the processing of your personal data?

You have the right to be informed whether the NLS is processing your personal data and if so, which data. You may submit a request to view your personal data using our form or submit a free-form request.

If you would like to receive information about your property, parcel or leasehold, you can use the NLS’s e-service (in Finnish or Swedish). The e-service provides access to basic property information and information on property ownership and mortgages, for example.

You have the right to request that the NLS rectifies any inaccurate personal data without undue delay. You  may submit a request for rectification using our form or submit a free-form request. 

Right to lodge a complaint with the Data Protection Ombudsman

You have the right to lodge a complaint with the Data Protection Ombudsman if you are of the opinion that the NLS has violated legislation on the processing of personal data.
